1.3 The provisions of these GTC form an integral part of the Accommodation Agreement entered into between the Provider and the Customer. Any arrangements in the Agreement that differ from these GTC shall prevail over the provisions of these GTC.
Article II
Establishment of the Contractual Relationship between the Provider and the Customer
2.1 An Accommodation Agreement between the Provider and the Customer is concluded either:
a) by entering into a separate written and/or oral agreement between the Provider and the Customer; or
b) by the Customer submitting an order to the Provider online via the Provider’s website available at www.novohradapartments.com and its acceptance by the Provider.
2.2 By entering into the Accommodation Agreement, the Provider undertakes to provide the Customer with accommodation and related services in the agreed scope and quality, and the Customer undertakes to pay the Provider the agreed price for the accommodation and the services related to the accommodation in the manner specified in the Accommodation Agreement.
2.3 The Customer may order accommodation and services related to the accommodation from the Provider in the Customer’s own name and/or for the benefit of a third party by telephone, by e-mail and/or via the Provider’s website available at www.novohradapartments.com by completing and submitting the relevant order form.
2.4 An order for accommodation and services related to the accommodation must contain:
a) the Customer’s first name, surname and date of birth and, in the case of a legal person, its name, registered office and Company ID No. (IČO);
b) the accommodation dates;
c) the scope, type and dates of use of the ordered services related to the accommodation;
d) the Customer’s contact details – telephone number, permanent residence address (street, house number, postal code, city, country), the Customer’s e-mail address, and the first name and surname of the contact person;
e) the method of payment for the accommodation and the services related to the accommodation.
2.5 The Provider must process the order for accommodation and services related to the accommodation no later than 24 hours after receiving it from the Customer, either by confirming or rejecting the order. If the order is confirmed, the Provider shall issue the Customer an electronic booking confirmation confirming the accommodation dates and the scope of the confirmed services related to the accommodation.
2.6 Upon confirmation of the order by the Provider, the agreement concerning the accommodation and the confirmed services between the Provider and the Customer is concluded. Upon conclusion of the Agreement, these GTC become binding on both the Provider and the Customer and form an integral part of the concluded Agreement.
Article III
Price and Payment Terms
3.1 The Customer is obliged to pay the Provider the agreed price for the accommodation and the services related to the accommodation ordered by the Customer.
3.2 If the price of the accommodation and the services related to the accommodation has not been specified in the Accommodation Agreement, the Customer is obliged to pay the Provider the price stated for the relevant accommodation dates and related services on the Provider’s website www.www.novohradapartments.com for the specific accommodation dates.
3.3 The price stated in the Accommodation Agreement, as well as the price stated on the Provider’s website and confirmed in the booking confirmation, is final and includes value added tax.
3.4 The price stated in the booking confirmation is binding. However, if the Provider’s input costs for energy, goods and utilities (e.g. gas, electricity, heat, goods, etc.) required for the provision of services under this Agreement increase to such a significant extent, with a corresponding increase in the prices of goods and services, that the Provider is no longer able to provide the ordered services and goods at the prices previously confirmed to the Customer, the Provider is entitled to increase the prices of the ordered goods and services provided that, at the time the prices are increased in accordance with the Provider’s price list, more than 60 days remain until the date on which the services under the confirmed order are to be used. A significant increase in the Provider’s input costs shall be deemed to have occurred if the current prices of the ordered goods and services under the Provider’s price list are 10% higher than the prices stated in the confirmed order. The Provider is obliged to inform the Customer of the new prices no later than two months before the services under the confirmed order are to be used. As a result of the notified price increase, the Customer is entitled, subject to the cancellation terms, to cancel the confirmed order up to 30 days before the date on which the services are to be used; in such case, the advance payment shall be refunded to the Customer in full. Without the Customer’s approval of the new prices, the Provider is not entitled to charge the Customer higher prices resulting from a significant increase in the Provider’s input costs. If the Customer does not confirm the newly changed prices within 7 days of the date on which the Provider notifies the Customer of the new prices, the Provider is entitled, subject to the cancellation terms, to withdraw from the Agreement or cancel the confirmed order. In such case, the Provider shall not be liable for any damage incurred by the Customer as a result of the withdrawal from the Agreement or cancellation of the order.
3.5 The price of the accommodation and the services related to the accommodation becomes due upon conclusion of the Accommodation Agreement, and the Customer is obliged to pay the price of the accommodation and related services after submitting a binding order through the payment gateway and/or, where payment by invoice has been agreed, no later than the due date stated on the relevant invoice.
3.6 The Provider is entitled to require the guest to provide a guarantee for the stay in the form of an advance payment of up to 100%, payable no later than 7 days after confirmation of the booking. The booking becomes binding only once the advance payment has been credited to the Provider’s account.
Article IV
Cancellation of Accommodation by the Customer and Cancellation Terms
4.1 The Customer is entitled to cancel the reserved accommodation by notifying the Provider by e-mail at recepcia@novohradapartments.com, stating the Customer’s identification details and the accommodation dates. If the ordered accommodation and services related to the accommodation are cancelled after conclusion of the Accommodation Agreement, the Provider is entitled to charge the Customer the following cancellation fees if the accommodation is cancelled within the following periods:
Ø if the accommodation is cancelled between the 14th and 8th day before the agreed accommodation date – the Provider is entitled to charge the Customer a cancellation fee equal to 50% of the total price;
Ø if the accommodation is cancelled 7 days or less before the agreed accommodation date – the Provider is entitled to charge the Customer a cancellation fee equal to 100% of the total price;
Ø in the event of early termination of the stay, the Provider is entitled to a cancellation fee equal to the remaining portion of the price paid for the unused part of the stay following its early termination;
Ø if the Customer fails to arrive for the accommodation without notifying the Provider of cancellation, the Provider is entitled to a cancellation fee equal to 100% of the price of the ordered services;
Ø for Christmas, New Year’s Eve and Easter stays, a 100% cancellation fee applies to bookings cancelled 14 days or less before the confirmed arrival date.
4.2 By entering into the Accommodation Agreement and the agreement for related services under these GTC, the Customer agrees and acknowledges that, in the event of cancellation or partial cancellation of the accommodation under the Accommodation Agreement, or failure to take up the accommodation under the Accommodation Agreement, the Provider is entitled to unilaterally set off the Customer’s claim for reimbursement of the price paid by the Customer for the reserved accommodation and related services against the Provider’s claim for payment of the cancellation fee in the amount specified in these GTC (Article IV, point 4.1 of these GTC), to the extent that the claims overlap.
Article V
Refund of the Price to the Customer upon Termination of the Accommodation Agreement
5.1 If the Customer cancels the accommodation under the Accommodation Agreement and the cancellation occurs at a time when the Provider does not apply cancellation fees under Article IV, point 4.1 of these GTC, or if the Customer has a justified complaint giving rise to an entitlement to a price reduction, the Provider shall refund to the Customer the price paid by the Customer and/or the relevant part thereof (where the accommodation is cancelled at a time when a cancellation fee of 50% of the accommodation price applies under Article IV, point 4.1, first indent, of these GTC, or where a reduction in the accommodation price is granted due to defects).
5.2 The Provider shall refund the funds using the same method by which the Customer paid them to the Provider. If the Customer paid the accommodation price through a payment gateway, the funds shall be refunded exclusively through that payment gateway, within 14 calendar days of the Customer’s cancellation of the accommodation or within 14 calendar days of the assessment that the Customer’s complaint is justified.
Article VI
Accommodation Conditions
6.1 On the day of arrival, the Customer may check in from 3:00 p.m. at the earliest, unless otherwise agreed in advance.
6.2 For individual requests (late check-in, late check-out), the Customer may contact the Provider’s staff by telephone at +421 948 528 311 or by e-mail at recepcia@novohradapartments.com.
6.3 If the Customer has made an advance payment, the Provider is obliged to hold the Customer’s booking until 10:00 p.m. on the day of arrival. If the Customer does not claim the reserved services by that time, the Provider is not obliged to refund the advance payment to the Customer.
6.4 If the Customer checks in before 6:00 a.m. on the day on which the stay begins, the Provider reserves the right to charge for an additional day.
6.5 The Customer is obliged to vacate the apartment/accommodation premises by 11:00 a.m. on the day of departure. If the Customer fails to vacate the apartment/accommodation premises by 11:00 a.m., the Provider is entitled to charge the Customer for an additional day of stay, unless otherwise agreed.
6.6 If the Customer has a confirmed booking and has paid an advance payment, and the Provider is unable to provide the Customer with the accommodation for serious reasons, the Provider is obliged to arrange appropriate alternative accommodation for the Customer at the Provider’s expense.
6.7 The Provider reserves the right, in exceptional cases, to offer the Customer accommodation other than that originally agreed, provided that it does not differ substantially from the confirmed order.
6.8 The Customer is entitled to receive all services agreed in the confirmed order.
6.9 No pets may be accommodated in the apartment/accommodation premises.
6.10 The Provider may extend the Customer’s stay only if the apartment/accommodation unit is available and the Provider has sufficient capacity.
Article VII
Rights and Obligations of the Customer during the Provision of Accommodation
7.1 In the premises in which accommodation is provided to the Customer under the Accommodation Agreement, the Customer must not:
a) move furnishings, make alterations, carry out repairs or otherwise interfere with the furnishings and equipment of the apartment/accommodation premises;
b) smoke, except in areas specifically designated for that purpose; in the event of a breach of this prohibition, the Provider may charge the Customer who breached the prohibition a penalty fee of EUR 250.00 for removing odours from the furnishings and equipment of the apartment/accommodation premises;
c) use electrical appliances with a power rating exceeding 1,000 watts;
d) carry or keep any weapon or ammunition;
e) bring in substances of a hazardous nature;
f) use any narcotic and/or psychotropic substances;
g) leave children under 10 years of age without adult supervision;
h) use their own electrical appliances other than an electric shaver, hair dryer, personal hygiene devices and similar appliances.
7.2 In the premises in which accommodation is provided to the Customer under the Accommodation Agreement, the Customer is obliged to:
a) dispose of waste exclusively in the designated containers;
b) observe quiet hours from 10:00 p.m. to 6:00 a.m.;
c) before leaving the apartment/accommodation premises in which the Customer is/was accommodated, switch off the lights, turn off the water taps and close the doors.
7.3 The Customer is entitled to request the return of items lost by the Customer in the accommodation/apartment premises. The Customer also acknowledges that the Provider stores found items at the accommodation premises for a maximum period of 3 months. After this period, the Provider shall hand over items of obvious value to the police and dispose of the remaining items.
Article VIII
Force Majeure Provisions
8.1 Force majeure (Lat. vis major) is a specific legal circumstance consisting of an extraordinary, unforeseeable and unavoidable event. As a result of vis major, an impediment to the performance of contractual obligations arises independently of the will of either contracting party. For the purposes of these GTC, an impediment includes, in particular, a natural disaster, armed conflict, revolution, terrorist activity, an epidemic, and circumstances of a domestic nature (nationwide strikes, legislative measures). In such a case (occurrence of vis major), the Provider shall not be obliged to provide the Customer with the agreed services at all, or shall only be obliged to provide them to the extent subsequently agreed individually, and the Customer shall not be obliged to use the ordered services on the reserved date.
8.2 The contracting parties are obliged to notify the other contracting party of this circumstance (the occurrence of vis major) without undue delay; the Provider shall also fulfil this obligation by publishing a notice of the occurrence of vis major on the Provider’s website.
8.3 Force majeure constitutes grounds for possible non-performance of obligations arising from the contractual relationship.
8.4 If an impediment to the performance of contractual obligations arises on the part of the Provider and/or the Customer due to force majeure, the contracting parties are obliged to agree on alternative performance of the subject matter of the Agreement (a new scope of services, a new date for the provision or use of the service). The Provider shall fulfil this obligation by allowing the Customer, within the Provider’s available capacity, to use the services provided by the Provider at the originally agreed value (price) within 12 months of the originally agreed commencement date for the Customer’s use of the services. If the Customer does not use the Provider’s accommodation services within that 12-month period, the Customer shall be deemed to have cancelled the entire order and a cancellation fee equal to 100% of the price of the ordered services shall apply. The Customer is not entitled to compensation for any damage arising as a result of vis major or other circumstances excluding liability.
Article IX
Compensation for Damage
9.1 The Provider shall not be liable for damage to items brought into or left in the accommodation premises by the Customer. The Provider shall not be liable for jewellery, money or other valuables kept in the accommodation premises.
9.2 The Provider shall not be liable for forgotten or lost items in the accommodation premises. This provision is without prejudice to Article VII, point 7.3 of these GTC.
9.3 The Provider shall not be liable for any damage caused by the Customer outside the apartment/accommodation premises. If the Customer is provided with a parking space near the accommodation (whether for a fee or free of charge), no contract of safekeeping is thereby created between the Provider and the Customer. In the event of loss of or damage to parked or moved motor vehicles and their contents, the Provider shall not be liable for the resulting damage, except for damage caused by the Provider intentionally or through gross negligence.
9.4 The Customer is liable for damage caused to the furnishings and equipment of the accommodation/apartment premises in accordance with the applicable legislation. If the Provider’s property is damaged or destroyed, the Provider is entitled to compensation from the Customer in the amount of the acquisition value of the damaged or destroyed property. The Customer is obliged to compensate for the damage incurred no later than on the day on which the Customer’s stay ends.
Article X
Delivery of Notices
10.1 Unless expressly agreed otherwise between the Provider and the Customer or otherwise provided by law, documents required to be delivered in writing shall also be deemed duly delivered if sent by e-mail.
10.2 Where documents are delivered by e-mail, the party receiving the e-mail is obliged to confirm receipt to the sending party no later than 3 working days after delivery of the e-mail; delivery of the confirmation of receipt of the e-mail shall be deemed the time of delivery. However, if receipt of a document sent by e-mail is not confirmed no later than 3 working days from the date on which it was sent, the document shall be deemed delivered upon expiry of the third working day following the date on which it was sent.
10.3 The Provider and the Customer are obliged to notify each other of any change in their delivery addresses without undue delay. A consignment shall be deemed delivered on the date on which it is returned to the sender, even if the addressee did not become aware of it. A consignment shall also be deemed delivered if it is returned to the sending contracting party even though that party sent it to the other party’s address known to it, with an indication that the addressee is unknown and/or that the addressee refused to accept the consignment.
Article XI
Complaints and Alternative Dispute Resolution
11.1 The Provider is liable for defects in the accommodation and the services related to the accommodation pursuant to Sections 622 and 623 of Act No. 40/1964 Coll., the Civil Code, as amended. However, the Provider shall not be liable for failure to provide an ordered service or for incomplete or incorrect provision of a service where this occurred as a result of circumstances on the Customer’s side (e.g. the Customer booking incorrect accommodation dates), third parties, or force majeure, in particular an internet outage, power outage, etc.
11.2 If the services provided to the Customer are of a lower quality or smaller scope than agreed in advance, the Customer is entitled to lodge a complaint.
11.3 The Customer is entitled to contact the Provider with a request for remedy if the Customer is dissatisfied with the handling of a complaint or believes that the Provider has infringed the Customer’s rights. If the Provider responds negatively to the request referred to in the preceding sentence or fails to respond within 30 days of its submission, the Customer may refer the matter to one of the alternative dispute resolution (ADR) entities under Act No. 391/2015 Coll. on Alternative Resolution of Consumer Disputes and on Amendments to Certain Acts, for example the Slovak Trade Inspection, with its registered office at: Prievozská 32, 827 99 Bratislava, Company ID No. (IČO): 17 331 927, which may be contacted for the above purpose at Slovak Trade Inspection, Central Inspectorate, Department of International Relations and Alternative Dispute Resolution, Prievozská 32, P.O. Box 29, 827 99 Bratislava 27, or electronically at ars@soi.sk or adr.@soi.sk, website https://www.soi.sk/, or the Customer may contact other authorised entities entered in the list maintained by the Ministry of Economy of the Slovak Republic. This is without prejudice to the Customer’s right to bring the matter before a court.
11.4 If the Customer becomes aware of grounds and facts that may be the subject of a complaint, the Customer is obliged to lodge the complaint without undue delay, but no later than 3 months after the service was provided by the Provider, in writing at the Provider’s registered office, by e-mail at reklamacie@novohradapartments.com, or by telephone at +421 948 528 311; otherwise, the right to lodge a complaint shall lapse.
11.5 To facilitate prompt handling of the complaint, it is advisable for the Customer to state: (I) the nature of the defect in the service provided, (II) the Customer’s identification details, (III) the Customer’s e-mail address, and (IV) the date on which the Customer was due to stay with the Provider.
11.6 When a complaint is lodged, the Provider is obliged to inform the Customer of the rights arising from the defective service by e-mail to the address from which the complaint was submitted or to the e-mail address stated in the complaint, namely that, in the case of a remediable defect, the Customer is entitled to a remedy free of charge or to the provision of a replacement service and, in the case of an irremediable defect, to an appropriate reduction in the price of the service or to withdraw from the Agreement. The Provider shall also enter the Customer’s complaint in the complaint record, stating the objective circumstances of the complaint. After careful examination, the Provider is obliged to decide immediately on the method of handling the complaint, or in more complex cases within 3 days. If this is not possible (e.g. because a complex technical assessment of the condition is required), the Provider is obliged to notify the Customer of the time limit for handling the complaint, which may not exceed 30 days.
11.7 The Provider is obliged to issue the Customer with written confirmation (by e-mail) of when the Customer exercised the right to lodge a complaint, the content of the complaint and the method of handling requested by the Customer, as well as confirmation of the date and method of handling the complaint, including confirmation of any repair carried out and its duration, or written reasons for rejecting the complaint.
Article XII
Final Provisions
12.1 These GTC and the legal relationships concerning accommodation and services related to accommodation shall be governed by the laws of the Slovak Republic.
12.2 The contracting parties agree that any disputes shall be heard and decided by the court having jurisdiction at the Provider’s registered office.
12.3 The Customer may consult the Provider’s Personal Data Protection Policy concerning the provision of accommodation and related services, available on the website www.novohradapartments.com.
12.4 These General Terms and Conditions shall enter into force and effect on 1 August 2026.
